Terms and Conditions
Please take the time to read our terms and conditions of business. By entering into a contract and using the Sea Spirit Kayaking website, you agree to these terms of use. Sea Spirit Kayaking reserves the right to modify, alter, or update these terms at any time, however any changes will not be retrospectively applied.
1. Sea Spirit Kayaking
a. It is the mission of Sea Spirit Kayaking to enable our clients to get as much enjoyment from sea kayaking as we get from it ourselves, and through the input of our highly committed and qualified coaches and guides, to exceed our clients’ aspirations in terms of paddling, exploration and expedition skill development.
b. Sea Spirit Kayaking does not do ‘off the self’ packages. Our approach is to work with our clients to build a package designed around them, beginning with an understanding of their ambitions and current skills. Sea Spirit Kayaking will work on the water with at most two clients at any one time, thereby ensuring a dedicated coaching and guiding experience. The best starting point is to have a conversation with us, and we can take it from there.
2. Bookings.
a. Activities can be reserved by submitting a completed booking form and paying the 25% deposit following confirmation of dates by Sea Spirit Kayaking. Any balance should be paid no less than 14 days prior to the commencement of the activity with a failure to do so potentially resulting in the loss of the deposit and reservation. Bookings made less than 14 days prior to a planned activity are of course welcome (though earlier booking is recommended, especially during holiday periods) with payment in full being required upon confirmation.
b. Places may be provisionally booked but will only be held for a maximum of 7 days. Should another firm booking request be received within this period, you will be notified and given first refusal.
b. All bookings will be confirmed by email and an invoice will be sent. Confirmation paperwork will be sent following the payment of the deposit, and will include a copy of the planned activity details and equipment advice.
c. Payment should be made by BACS to the following account. A £10 fee will be added to for payments from non-uk banks to cover charges:

d. Bookings for activities will necessarily be described in indicative terms given the weather dependent nature of sea kayaking, though it is core to the ethos of Sea Spirit Kayaking that we will always seek to fulfil the aspirations of clients in terms of desired outcomes, which may include locations and the precise programme. The final decision on such matters ultimately rests with the coach/guide, however, who will use their judgement and experience to meet client need to the maximum degree possible. e. The quoted price of £150/person and £250/two people are inclusive of up to one day (7 hours) of coach/guide hire, equipment, and time/fuel costs of up to one hour from base. Any additional costs or fees will be discussed and agreed with clients prior to a booking being confirmed.
f. A discount will be offered to clients seeking a longer term course of coaching or guiding, and Sea Spirit Kayaking with work with you to develop a programme geared to your medium to long term outcomes. We will also agree a tailored fees schedule.
3. Amendment/Cancellation by the Client.
a. Sea Spirit Kayaking operates a booking ‘cooling-off’ period of 14 days from the date of confirmation during which a booking can be cancelled and any payment made returned in full. This ‘cooling-off’ period will not apply to any bookings made within 56 days (eight weeks) of the activity and will not extend into this period.
b. Sea Spirit Kayaking will always seek to accommodate a request from a client to change their activity or dates if at all possible, though this will be subject to an administrative charge if the change leads to additional non-recoverable expenses for Sea Spirit Kayaking.
c. All cancellations must be in writing and acknowledged by Sea Spirit Kayaking. Any refund after the cooling-off period will be at the discretion of Sea Spirit Kayaking. Whilst we will always seek to be accommodating, a refund can only be guaranteed if a date/place can be re-sold.
d. Substitution of the original client for another may be made, provided the substituting client satisfies the requirements of the activity and a new booking form is signed and submitted.
4. Amendments and Cancellation by Sea Spirit Kayaking.
a. Sea Spirit Kayaking will always make every effort to to ensure that a booked activity takes place as planned, however there will inevitable be times when activities may impacted, with poor and especially windy weather being the main cause of problems. Sea Spirit Kayaking will notify clients of any such exigency as soon as practicable, and it is usually possible to move the activity to a more sheltered location where the client’s desired outcomes can still be met. In the unlikely event that this isn’t possible, we will work with the client to identify an alternative date. We do, however, recognise, that on occasions, such as where someone is only visiting the area for a holiday, this is not possible, in which case we will offer a full refund.
b. In the event of cancellation by Sea Spirit Kayaking for administrative reasons, clients will be offered the choice of either rescheduling their activity or a full refund of all fees.
c. Clients accept they should have the fitness and competence commensurate with their chosen activity. If in the opinion of the coach/guide that the fitness or competence level of a participant may compromise the safety of the activity, we reserve the right to cancel or terminate their participation. It is therefore important that clients are open and honest with the coach/guide including about any medical condition. We can accommodate most needs , but if a client is aware of anything that may affect safety or enjoyment of themselves or others during the the activity, they must advise this at the time of booking.
d. Any participant under the influence of drugs or alcohol will not be able to take part in activities. We also reserve the right to exclude any participant for safety reasons at any time, and no refund will be given.
e. In the event of force majeure (unusual and unforeseen circumstances beyond our control, the consequences of which are unavoidable e.g. strike, riot, natural disaster, act of war or terrorism) and Sea Spirit Kayaking is forced to cancel or curtail an activity, we will endeavour to provide a suitable alternative, but we cannot pay compensation or accept liability for the return of fees.
f. The final choice of venue and decision to operate is based on the experience of our staff.
5. Insurance.
a. Sea Spirit Kayaking is covered to the sum of £10,000,000 for public liability, however we also recommend that that customers acquire insurance for cancellation and curtailment and loss/damage of personal belongings and equipment.
b. It is a condition of booking for all activities that you are covered by adequate insurance for the duration of the itinerary and for the activities undertaken - something that principally relates to non-uk clients and to overseas trips. Such insurance must include cover for medical and emergency expenses (including repatriation), personal accident, injury and death. In the event of emergency medical expenses the responsibility of such costs will be borne by the customer. It is also recommended that you have insurance cover to the value of any personal or loaned equipment and boats.
6. Safety and Risk.
a. The safety of clients is our primary concern. All guides and coaches employed by Sea Spirit Kayaking hold current, validated kayaking qualifications issued by the Scottish Canoe Association/British Canoe Union, and are qualified first aiders. All guides/coaches will be equipped with repair kits, a first aid kit, and communication equipment such as flares, VHF radio, mobile phone and personal locator beacon (PLB). All activities have been risk assessed.
b. There will always, however, be some risk involved in adventure activities including kayaking. Some of these risks might contribute to the loss or damage of your personal clothing/equipment, feelings of discomfort, fear, apprehension, or even accidental injury, illness, or trauma, which in very rare cases can be extremely serious serious. It is a responsibility of both coach and client to ensure that any such risks are minimised, and it is important that clients inform the coach of any concerns or anxieties they may feel during the activity. Above all, sea kayaking is a hugely enjoyable activity, and it is an important role for a skilled coach/guide to minimise and manage any risks that do exist.
c. Sea Kayaking is also a highly accessible activity that is open to adults of any age and older children (large enough to fit a sea kayak), including people with a wide range of health conditions and disabilities. To help ensure any risks can be appropriately managed, it is the responsibility of participants to advise Sea Spirit Kayaking of any relevant health conditions (including pregnancy), injuries, serious allergy, or disability that may exist, and also to notify of any medication that may be carried (such as an inhaler or epipen), and where it is located. g. Sea Spirit Kayaking will not be responsible for your actions or safety should you undertake independent activity during the trip or fail to follow clear safety guidance from the coach/guide.
7. Under 18s.
a. Sea Spirit Kayaking does not work with unaccompanied children under 18 years of age. Accompanied children may participate in sea kayaking, though as a rule of thumb those under the age of 16 are unlikely to have the size and strength to participate safely or effectively, so please discuss your requirements before booking.
b. All Sea Spirit Kayaking coaches and guides and have undertaken relevant safeguarding (child protection) training and have been PVG checked.
8. Personal Belongings.
Sea Spirit Kayaking cannot be held responsible for personal belongings and equipment. Items stored in our vehicles or with our staff is at your own risk. If you take valuables on our activities e.g. jewellery, watches, glasses, non-waterproof cameras etc, or choose to use your own kayaks and equipment, you do so at your own risk. It is recommended that you have insurance to cover your personal equipment.
9. Kayaking Equipment.
a. Sea Spirit Kayaking can provide all paddle-sport specific equipment to clients, something that is included within the cost of a booking. Other than a cagoule and pogies, this does not however include clothing. A recommended list of food/drinks and personal equipment you may wish to take on your activity will be provided, though any such information, which will relate to climate, clothing, equipment and nutrition, is given in good faith but without responsibility on the part of Sea Spirit Kayaking.
b. Sea kayaking equipment is expensive with the boats operated by Sea Spirit Kayaking costing approximately £3,000 each and paddles around £300. If you borrow sea kayaks or other equipment from us, you must return it in the same condition, subject to normal wear and tear. You may be held liable for the repair, recovery or replacement of any breakages or losses of our equipment, particularly if this arises from failing to follow clear instructions from the coach/guide in relation to their same use.
10. Feedback and Complaints
a. Ensuring that client aspirations are met or exceeded is why Sea Spirit Kayaking is in business. We therefore actively encourage feedback, and would welcome your comments and suggestions verbally, in writing, or electronically – via the website, google business, Facebook or Linkedin. We are always interested to see any photographs you may take and any photographs or video we take will be made freely available to you.
b. If you have a complaint about your activity activity or feel it is not meeting your needs, you should make it known to the coach/guide at the earliest opportunity in order that immediate corrective action can be taken. If you feel any complaint has not been properly dealt with, Sea Spirit Kayak will endeavour to agree a settlement with you. Any outstanding complaint not resolved during the course/trip should be notified to us in writing within 30 days of the scheduled end of the course/trip.
11. Company Information
Sea Spirit Kayaking is an operating division of Steve Bell Coaching and Consulting Limited, 19 Station Gate, Glassford, Strathaven, Scotland ML10 6GB (Company Number SC562456).
12. Data Protection.
Steve Bell Coaching and Consulting Limited/Sea Spirit Kayaking is registered with the Information Commissioner’s Office. We take your protection of any data we hold about you very seriously and will do everything possible to ensure that data is and will continue to be collected, stored, processed, maintained, cleansed and retained in accordance with the current GDPR regulations. We will not sell or share your personal details or e-mail address to any other party for any other reason other than the emergency services in the event of an incident. We may contact you to keep you informed of future activities.
The information, services, products and materials available on the Sea Spirit Kayaking website, including, without limitation, text, graphics and links, are provided on an ‘as is’ basis without warranty. This site may contain links to other sites on the Internet that are owned and operated by third party vendors and other third parties. You acknowledge that Sea Spirit Kayaking is not responsible for the availability of, or the content located on or through, any external site. You should contact the site administrator or webmaster for those external sites if you have any concerns regarding such links or the content located on such external sites.
15. Covid Arrangements.
a. Whilst the Covid pandemic is ongoing, Sea Spirit Kayaking will require clients and coaches/guides to confirm immediately prior to the booked activity that they are not displaying any covid symptoms, have not been in close contact with anyone displaying covid symptoms, have not been asked to self-isolate or quarantine, and have had a negative result from a lateral flow test. Should any of these conditions not be met, the booked activity will be postponed to an alternative and mutually agreeable date.
b. All Sea Spirt Kayak coaches/guides have been vaccinated against Covid, and it is a condition of booking that clients have received covid vaccinations or have a medical reason why this has not been possible. Clients will also be required to observe any covid regulations required by the Scottish Government at the time of their activity. Failure to do so may result in the termination of said activity.
